Booking your holiday with Pure High Ltd 
To make your booking with Pure High Ltd you must complete our booking form which can be found on our website. The booking form must be completed by the party leader who will be responsible for all payments booked on behalf of all members of the party named on the booking form and in doing so confirms acceptance of these terms and conditions on behalf of all members of the party. 
 
A contract will only exist between you and Pure High Ltd when we have received from you a completed booking form and your deposit and we have sent to you written confirmation of your booking. 
 
Our prices are quoted in U.K. Sterling. Payment will be accepted by Paypal, U.K. Sterling cheque or Bank Transfer. Please contact us for details. A deposit of £100 per person is required at the time of booking. On receipt of the deposit and completed booking form we will send written confirmation of the booking and details of the balance due.  
Please note: There is a 3% surcharge for credit card payments via Paypal. 
 
Final payment methods 
 
Prior to arrival 
Paypal: payment will be due 2 weeks prior to your holiday start date. 
Bank Transfer: payment will be due 2 weeks prior to your holiday start date.  
Cheque: payment will be due 3 weeks prior to your holiday start date to allow for bank clearance. 
 
Should you fail to pay the full amount by the due date then this will be considered to be a cancellation of the holiday on your part and we reserve the right to impose a cancellation charge. See Cancellation by you below.  
 
Making your booking with us means that you have read, understand and accept these terms and conditions and agree to abide by them. 
Cancellation by us 
In the event of any exceptional circumstances beyond our reasonable control, we reserve the right to cancel your holiday. Any cancellation by us will result in a full refund to you of any monies already paid to us. As a result of us cancelling your holiday, we cannot be held responsible or liable for any expenses, losses or costs that you or any other member of your party may incur. 
 
Cancellation by you 
Cancellation of your holiday by you or any other member of your party must be confirmed in writing to us. Should you cancel your holiday at any time before your arrival date you will incur a cancellation charge which is the loss of your deposit. 
 
Changes to your booking by you 
Any changes that you wish to make to your booking after you have received written confirmation from us must be confirmed in writing to us as soon as possible. 
We will always endeavour to meet your requirements but cannot guarantee to accept any changes to your booking. Any changed booking will be subject to any increased costs which are relevant to the change. Changed bookings which are accepted will be issued with a new booking confirmation. Should required changes not be possible and you choose to cancel your holiday with Pure High Ltd, cancellation charges will be incurred as stated in our terms and conditions. 
 
Changes to your booking by us 
We reserve the right to change any holiday details before and after bookings have been confirmed. If these changes are of a significant nature we will notify you as soon as reasonably possible. Should you choose to cancel your holiday as a result of these changes, you may within 7 days of such notice, elect in writing, to cancel your holiday with us. On receipt of your written cancellation, you will receive a full refund of any monies already paid to us. We will not however, refund any personal expenses you may have incurred as a result of your booking such as flight payments, travel insurance, equipment purchases etc. 
 
Personal Travel Insurance  
All party members are required to have adequate outdoor activity travel insurance covering hill / mountain walking, medical treatment and repatriation for their walking holiday in Spain. We reserve the right to cancel your booking at any time if we are not satisfied that you have an adequate insurance policy to cover all such risks. In the event of emergency medical rescue and/or repatriation during your holiday by whatever means, the responsibility of such costs will be borne by the client. It is therefore essential that adequate cover is in place. We also recommend that your insurance policy includes cover for personal items and baggage. All personal equipment and luggage are, at all times, at your own risk. We will not be responsible whatsoever for any loss or damage to your personal equipment and/or luggage. We also recommend that you obtain and bring your EHIC card with you which enables a citizen from the EU to healthcare anywhere within the EU. It is the responsibility of you and all members of your party to ensure the insurance cover purchased is suitable and adequate for your particular requirements. Pure High cannot be responsible for your costs if you fail to do so. On arrival you will be asked to produce your travel insurance policy. Failure to produce an adequate insurance policy means that you will be excluded from all walks and refunds will not apply in any case. 
 
Independent Travel Arrangements 
We will not be responsible or liable for your actions or your safety for any independent travel you undertake before, during (if you choose to leave) or after the holiday. This will include any independent travel or activities including walking which is undertaken during your holiday. 
 
Risk 
Whilst we maintain high professional standards of care and safety, you must be aware that mountain walking involves an acceptance of objective risks and taking responsibility for your own actions. 
 
Liability 
We cannot be made liable for any injury, illness or death of any person on any walk in any case. We cannot accept any responsibility for any loss or damage to your personal effects which is beyond our control. This includes loss, damage, fatal or any other illness or injury sustained by you during your holiday/walks, nor will we be liable for any uninsured losses of your property, except where such illnesses, injuries or losses arise as a result of our negligence. Medical advice or treatment given by any doctor or guide on our behalf is done in good faith without liability. We cannot be held responsible for any mishap to yourself or your property, and in particular for the consequences of flight cancellations, road traffic delays, vehicle accidents, strikes, sickness, government customs, police intervention or other such happenings. 
 
Client Responsibility  
During the walks you will follow all legitimate instructions and decisions of the person leading the walks. You can be excluded from the walks due to your ill-health, safety or you compromising the success and enjoyment of other walk members without any refund. If you contravene the decisions or advice of your guide, or undertake independent hill / mountain walking activities during your holiday, it will terminate all protection and duty of care from us. If you voluntarily leave a walk early you agree to relinquish the guide of any duty of care. You are fully responsible for bringing the appropriate equipment, details of which will be sent to you at the time of booking. 
 
State of Health 
You must be in good health and a level of fitness commensurate with your walking holiday. For your own safety we would ask you to inform us of any illness (past or present), allergies or recurrent medical conditions that you suffer from which may affect your walking with us. 
Force Majeure  
We cannot accept liability or pay any compensation where our contractual obligations is prevented, affected or delayed by ‘force majeure’. In these terms and conditions, ‘force majeure’ means any event or circumstance which we, or our third party suppliers, could not reasonably foresee or avoid. These events or circumstances include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions and all events or circumstances outside our reasonable control. We cannot be responsible for any loss, cost, delay expense or detriment to the enjoyment of your holiday due to weather conditions. Refunds will not be given for unfavourable weather conditions. 
 
Indemnity 
You shall indemnify us for any damages including legal expenses arising out of third party claims which may be caused due to your act, omission or negligence, deliberate or otherwise during your holiday. 
 
Disclaimer 
If the named guide is not available for any given walk or has to be changed, you will be notified as soon as possible. We are not responsible as to the quality and standard of any services provided by any third party engaged for the holiday, such as accommodation, transportation and food provided during the holiday even after taking all reasonable efforts. 
 
Information Provided 
Any information provided by Pure High on climate, clothing, equipment etc. is given in good faith but without responsibility on the part of Pure High Ltd. At the time of writing, all the information on this website was to our knowledge, accurate and written in good faith. Pure High cannot take responsibility for any misunderstandings arising from a guest not reading the information thoroughly. 
 
Complaints 
At Pure High Ltd we will always try and resolve any complaints or problems as soon as possible. Any complaints should be made clear to us as soon as they arise. 24 hours must be allowed for us to investigate the matter and to take any action in light of your complaint. Your custom is very important to us and we will always do our very best to help you. 
 
Jurisdiction 
These terms and conditions will be interpreted in accordance with the laws of England and will be subject to the jurisdiction of the English courts.
